Content Generation Terms

The Services may include features to assist you in the generation of text, image or other content (such features, “Content Generating Features”). 

These Content Generation Terms, along with our Terms of Service and any policies or other legal terms referenced herein or therein, apply to your access to and use of Content Generating Features. These Content Generation Terms are incorporated by reference into our Terms of Service. Any capitalized terms (or lowercase terms specifically defined in our Terms of Service) not defined in these Content Generation Terms have the meanings set forth in our Terms of Service or Product Specific Terms. Except as otherwise expressly set forth in these Content Generation Terms, in the event of a conflict or inconsistency, the rest of the Agreement shall govern, followed by these Content Generation Terms. 1. Content Generating Features. The Content Generating Features enable you to provide text or other User Content (“Input”) and receive text, images or other generated content (“Output”) in return. Input may include User Content from Your Site and details about the style, tone and nature of Your Site (your “Brand Identity”). Your Brand Identity may be auto-generated on your behalf, and may be used by you to ensure the returned Output more accurately matches the style, tone and nature of the User Content on your site. Your use of Output is subject to your compliance and the compliance of the Output with these Content Generation Terms and our Terms of Service, Acceptable Use Policy and the rest of the Agreement. If you add Output to Your Site, including in editor mode or a published version of Your Site, such Output is your User Content and is subject to the provisions relating to User Content in our Terms of Service.

2. Warning about Content Generating Features. Artificial intelligence software which generates content is a new and emerging technology. Output may be inaccurate, strange, or not fit for use or purpose. Additionally, Output may not be unique, whether across all Squarespace users or other users of content generating software provided by AI Software Service Providers (as defined below). For example, if you and another user provide the same or similar Input, you may receive the same or similar Output. Even if Output received by someone other than you is the same as Output received by you: (a) only the Output received by you is your User Content; and (b) the similar Output received by someone other than you is their User Content.

3. Rights and Licenses

3.1. AI Software Service Providers. In addition to the license you grant to us under Section 2.2 of our Terms of Service, you also grant Squarespace (including our third party hosting providers acting on our behalf) a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license to: (a) use your Input and Output to improve and promote the Content Generating Features; (b) transfer your Input to any third party service provider providing us with artificial intelligence software services (each, an “AI Software Service Provider”) for the AI Software Service Providers to use in accordance with its terms and policies; and (c) enable AI Software Service Provider to use any Output they generate from your Input in accordance with its terms and policies. 

3.2. Ownership of Input and Output. Subject to the provisions of these Content Generation Terms and notwithstanding any provision to the contrary in our Terms of Service, to the extent Output may be owned under applicable laws, as between you and Squarespace, you are the owner of all your Input and Output.

4. Your Responsibilities. You are responsible for: (a) thoroughly reviewing all Output (including without limitation to verify its accuracy and reliability) before publishing, distributing, displaying or otherwise using such Output; (b) deciding whether to edit, remove and/or publish on Your Site or otherwise use Output; and (c) ensuring that your Input and Output complies with applicable laws, these Content Generation Terms and our Terms of Service, Acceptable Use Policy and the rest of the Agreement. 

5. Additional Restrictions on Use of the Content Generating Features. In addition to the restrictions on use of our Services in our Acceptable Use Policy, you may not use Content Generating Features to: (a) mislead End Users or any others with access to the Output that such content was human-generated; (b) create Output which: (i) provides medical advice or includes information about diagnostic or treatment for a medical condition; or (ii) provides legal or financial (including tax and investment) advice; (c) create or use Output to condone, enable, promote or commit any act: (i) of violence; (ii) that could result in death or personal injury; or (iii) which is in violation of applicable law; or (d) provide Input which constitutes personal information of yourself or anyone else, including without limitation names, email addresses or data concerning an individual’s race, ethnicity, nationality, health status, religious beliefs, gender identity or sexual orientation.  

6. AI Software Service Providers. The Output of the Content Generating Features is generated by artificial intelligence software provided by our AI Software Service Providers. If you use the Content Generating Features, your Input will be shared by Squarespace to the applicable AI Software Service Provider and your Output will be generated by the applicable AI Software Service Provider.
